Use of Our Services

1.    Eligibility: You must be at least 18 years old to use our services. By using our services, you represent and warrant that you are of legal age and have the authority to enter into these Terms and Conditions.

2.    Bookings: All bookings are subject to availability and will be confirmed via email. A retainer fee may be required to secure your booking.

3.    Service Changes: We reserve the right to make changes to our services and pricing at any time without prior notice. However, we will honor the pricing agreed upon at the time of your booking.

Payments

1.    Payment Terms: Full payment must be made prior to the event. We accept various forms of payment, including credit cards and electronic transfers.

2.    Retainer: A non-refundable retainer fee may be required to secure your booking. The retainer amount will be specified at the time of booking.

3.    Cancellations: If you need to cancel your booking, please notify us as soon as possible. Cancellation policies and any applicable fees will be detailed in your booking confirmation.

Use of Content

1.    Client Content: You grant ELEMNT Photo Booth Co. a non-exclusive, royalty-free, worldwide license to use, reproduce, and display photos and videos taken at your event for marketing and promotional purposes.

2.    Intellectual Property: All content provided by ELEMNT Photo Booth Co., including but not limited to text, graphics, logos, and images, is our property and protected by copyright laws. You may not use, reproduce, or distribute our content without our express written permission.

Liability

1.    Service Performance: While we strive to provide the best possible service, we do not guarantee that our services will meet all your expectations. Our liability is limited to the amount paid for the services.

2.    Event Delays: ELEMNT Photo Booth Co. is not responsible for delays or interruptions caused by factors beyond our control, including but not limited to weather conditions, technical issues, or acts of God.

SMS/MMS Photo Delivery Terms

ICON Booths by ELEMNT Photo Booth Co. offers optional digital photo and video delivery by text message.

Guests may request delivery by selecting “Text My Photo,” entering their own mobile number, reviewing the SMS disclosure, and tapping “Send My Photo.” By completing that process, the guest agrees to receive one transactional SMS or MMS containing the requested photo or video, or a link through which it can be accessed.

Message frequency is one message per photo-delivery request, although an additional response may be sent when a guest requests help or opts out. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance.

Consent to receive a photo-delivery message is optional and is not a condition of purchasing any product or service. Photo-delivery consent does not authorize recurring promotional messages or marketing communications from ELEMNT Photo Booth Co., ICON Booths, an event sponsor, or any other third party.

Mobile carriers are not responsible for delayed or undelivered messages. Digital photo links may be available for a limited period, and guests are responsible for saving their files before the stated expiration date.

Privacy

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Missouri/St. Louis City. Any disputes arising out of or related to these terms will be subject to the exclusive jurisdiction of the courts located in Missouri/St. Louis City.

Changes to Terms & Conditions

We may update these Terms and Conditions from time to time. Any changes will be posted on this page, and the date of the latest revision will be indicated at the bottom. Your continued use of our services after any changes signifies your acceptance of the new terms.
